  6. NOTICE TO USER:
  7. THIS IS A CONTRACT.  BY INDICATING YOUR ACCEPTANCE BELOW, YOU 
  8. ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.  This 
  9. Adobe Systems Incorporated ("Adobe") End User License Agreement accompanies an 
  10. Adobe¿ software product ("Software") and related explanatory written materials 
  11. ("Documentation").  You must read this Agreement carefully before indicating acceptance 
  12. at the end of the text of this Agreement.  If you do not agree with the terms and 
  13. conditions of this Agreement, decline where instructed, and you will not be able to use 
  14. the Software.

  16. Adobe grants to you a nonexclusive license to use the Software and Documentation, 
  17. provided that you agree to the following:
  18. 1.  Use of the Software.  You may install and use the Software on a single computer.
  19. 2.  Copyright.  The Software is owned by Adobe and its suppliers, and its structure, 
  20. organization and code are the valuable trade secrets of Adobe and its suppliers.  The 
  21. Software is also protected by United States Copyright Law and International Treaty 
  22. provisions.  You must treat the Software just as you would any other copyrighted 
  23. material, such as a book.  You may not copy the Software or the Documentation.  You 
  24. agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or 
  25. otherwise attempt to discover the source code of the Software.  You agree not to attempt 
  26. to increase the functionality of the Software in any manner.  Except as stated above, this 
  27. Agreement does not grant you any intellectual property rights in the Software.
  28. 3.  No Warranty.  YOU ACKNOWLEDGE THAT THE SOFTWARE IS A "TRY-OUT" 
  29. VERSION OF AN ADOBE PRODUCT, CONTAINING LIMITED FUNCTIONALITY.  
  30. ADOBE IS LICENSING THE SOFTWARE ON AN "AS-IS" BASIS, AND ADOBE 
  31. AND ITS SUPPLIERS MAKE NO WARRANTIES EXPRESS OR IMPLIED, 
  32. INCLUDING, WITHOUT LIMITATION, AS TO NON-INFRINGEMENT OF THIRD 
  33. PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR 
  34. PURPOSE.  IN NO EVENT WILL ADOBE OR ITS SUPPLIERS BE LIABLE TO 
  35. LICENSEE FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, 
  36. INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF  
  37. REPRESENTATIVES OF SUCH PARTIES HAVE BEEN ADVISED OF THE 
  38. POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD 
  39. PARTY.  Some states or jurisdictions do not allow the exclusion or limitation of 
  40. incidental, consequential or special damages, or the exclusion of implied warranties or 
  41. limitations on how long an implied warranty may last, so the above limitations may not 
  42. apply to you.  To the extent permissible, any implied warranties are limited to ninety (90) 
  43. days.  This warranty gives you specific legal rights.  You may have other rights which 
  44. vary from state to state or jurisdiction to jurisdiction.  
  45. 4.  Transfer.  You may not rent, lease, sublicense or lend the Software or 
  46. Documentation.  You may, however, transfer all your rights to use the Software to 
  47. another person or legal entity provided that you transfer this Agreement, the Software, 
  48. and the Documentation to such person or entity and that you retain no copies, including 
  49. copies stored on a computer.
  50. 5. Governing Law and General Provisions.  This Agreement will be governed by the 
  51. laws in force in the State of California excluding the application of its conflicts of law 
  52. rules.  This Agreement will not be governed by the United Nations Convention on 
  53. Contracts for the International Sale of Goods, the application of which is expressly 
  54. excluded.  You agree that the Software will not be shipped, transferred or exported into 
  55. any country or used in any manner prohibited by the United States Export Administration 
  56. Act or any other export laws, restrictions or regulations.  This Agreement shall 
  57. automatically terminate upon failure by you to comply with its terms.  This Agreement 
  58. may only be modified in writing signed by an authorized officer of Adobe.
  59. 6. Notice to Government End Users.  If this product is acquired under the terms of a:  
  60. GSA contract- Use, reproduction or disclosure is subject to the restrictions set forth in the 
  61. applicable ADP Schedule contract;  DoD contract- Use, duplication or disclosure by the 
  62. Government is subject to restrictions as set forth in subparagraph (c) (1) (ii) of 252.227-
  63. 7013;  Civilian agency contract- Use, reproduction, or disclosure is subject to 52.227-19 
  64. (a) through (d) and restrictions set forth in the accompanying end user agreement.
